Letter from Committee Chair

The San José • Evergreen Citizens’ Bond Oversight Committee is pleased to submit this annual report on the district’s two general obligation bond programs to the residents, taxpayers, and voters of the San José • Evergreen Community College District for the fiscal year 2010-2011.

In 2004, San José • Evergreen Community College District passed a $185M general obligation bond initiative, Measure G-2004.  In November of 2010, the district once again received strong community support with the passing of Measure G-2010, a $268M general obligation bond initiative.  These bond measures have the common goal of improving and equipping the teaching environments to better serve our students needs.  The Committee and the District wish to thank the community for their continued support of our students.

The Citizens’ Bond Oversight Committee (CBOC) has the responsibility of providing oversight on both Measures G-2004 and G-2010.  The principal duties of the Committee are to ensure that the bond proceeds have been expended for the purposes set forth in the ballot language for each bond, report the progress annually to the public and provide a compliance statement.  The San José • Evergreen Community College District’s Board of Trustees is responsible for monitoring the project list, the priority of projects and approval of budgets/spending levels of individual projects.

The committee is pleased with the progress made during this fiscal year on both bond programs.  Measure G-2004 saw continued progress on its remaining projects which you will see highlighted in the body of this report. With respect to Measure G-2010, the bond was passed and the initial planning activities of a large program were initiated during this reporting year.  Lessons learned on Measure G-2004 informed the set-up of the new bond program.

The colleges’ facilities master plans defined the initial project list, preliminary budgets and schedules were developed and continue to be refined, the program and construction management firm and the consulting firm for the program’s Environmental Impact Report (EIR) were selected through a defined process and began their work, preliminary facilities assessments were made, and processes and procedures were developed.  It has been a busy year!

The Committee wishes to report that, to the best of its knowledge, the San José • Evergreen Community College District is in full compliance with the responsibilities as described in Article XIIIA, Section 1 (b)(3) of the California State Constitution, which address bonded indebtedness incurred by a community college district.  We encourage the community to visit the Measure G web site for additional information about the projects and expenditures, as well as our planned meeting dates and times for the coming year.

Measure G-2004 Ballot Language

"San José City College and Evergreen Valley College Improvement Measure: To prepare students for jobs and transfer to four-year universities by:

•  Building art, science and math classrooms and labs
•  Expanding healthcare job training facilities
•  Upgrading, acquiring, constructing and equipping  facilities sites and classrooms.

Shall San José Evergreen Community College District issue $185 million in bonds, at legal rates, with citizen’s oversight, guaranteed annual audits, and no money for administrators' salaries and with increasing existing tax rates?"

In November 2004 the voters of San José and Milpitas approved Measure G-2004, a local General Obligation Bond, in the amount of $185 million. Measure G-2004 passed with a 65.39% approval by the communities of greater San José and Milpitas.

Review of Expenditures

The schedule of proceeds and use of general obligations bonds for the fiscal year ended June 30, 2011, was compiled by an independent third-party auditing firm as required by Proposition 39. The fiscal and performance audit engagement was performed by Perry-Smith, LLP, in accordance with attestation standards established by the American Institute of Certified Public Accountants. Measure G-2004 Featured Projects

SJCC: Multi-Disciplinary + Arts

Budget: $30,868,757
Est. Completion Date: July 2012

Project Description:
A 31,000 SF facility that has been designed to house a multi-disciplinary wing and the Music, Fine Art & Ceramics departments.  Also included in the project will be an Art Gallery and offices with support facilities for faculty who will be in this facility. This project is being implemented using the design-build project delivery, the use of Building Information Modeling (BIM) and certified as a LEED® Silver building by the USGBC.

Highlights:
Won the 2011 Structures Award as the Best Public Civic Project from the San Jose/Silicon Valley Business Journal.

EVC: Critical Infrastructure Phase 1

Budget: $3,809,839
Est. Completion Date: January 2012
Project Description:
Installation of new chilled water and heating direct buried piping at Cedro and Gullo to improve the CHW/HHW lines. Installation of BAAQMD compliant burner and controls at Central Plant Rebuilt compressor for Chiller #3, and installation of new motor. Ensured other chillers are functioning properly by performing tube cleaning and testing. Tune up and cleaning of cooling towers. Retrofit and upgrade UPB’s main circuit breaker at Central Plant. Perform testing on load centers UPA and UPB and associated transformers and circuit breakers at Central Plant Improve the reliability of cooling of the ITSS computer room by installing a new dual cool computer room air conditioning unit and associated condenser. Installation of new pipe supports in the main EVC tunnel as well as at the ITSS tunnel and the demolition of the associated corroded supports. Installation of new expansions joints, guides and anchors for the CHW and HHW piping that have excessive corrosion and/or have been determined to be leaking.

Measure G-2010 Ballot Language

"To better prepare San Jose City College / Evergreen Valley College students for good paying jobs and transfer to four-year colleges, shall San Jose Evergreen Community College District:

• Upgrade, acquire, construct energy-efficient, technology driven teaching classrooms, labs, sites, facilities/equipment for health/science, general education/job-training,
• Upgrade outdated electrical, plumbing, heating/ventilation systems,

by issuing $268 million in bonds at legal rates, qualifying for matching funds with citizen oversight, no money for administrator salaries, all funds staying local?"
Measure G-2010 passed with a 58.81% approval by the voters of greater San Jose and Milpitas. A Citizens' Bond Oversight Committee has been selected and approved by the Board of Trustees. This Citizens' Bond Oversight Committee will provide oversight on both Measure G-2004 and Measure G-2010.
